You mean you are using it for HTML documents generated from DocBook
documents? If you use it for DocBook documents you are abusing Tidy AFAIK.

Regarding problems with Tidy, I'd ask the Tidy people.

xmllint --format might work for you.

If you encounter issues with xmllint, report them at
http://xmlsoft.org/bugs.html .
Alternatively, you could use a good XSLT processor such as Saxon;
especially recent (XSLT 2) versions offer some useful options for the
tasks you describe.
