That is because you haven't done what Mike suggested. Try
<?xml version="1.0" encoding="UTF-8"?>
<xsl:stylesheet version="1.0"
xmlns:xsl="http://www.w3.org/1999/XSL/Transform"
xmlns:msxsl="urn:schemas-microsoft-com:xslt"
>
<xsl:output method="xml" version="1.0" encoding="UTF-8"
indent="yes"/>
<xsl:template match="/elem">
<xsl:variable name="rtf">
<xsl:for-each select="ns[@type='extra']">
<xsl:element name="{@prefix}:dummy"
namespace="{text()}"/>
</xsl:for-each>
</xsl:variable>
<xsl:element name="{@name}">
<xsl:copy-of
select="msxsl:node-set($rtf)/*/namespace::*" />
</xsl:element>
</xsl:template>
</xsl:stylesheet>
Why do you need to do this though?
