make uses /bin/sh. /bin/sh doesn't understand the >& construct. It
is not portable.
Use
HAVE_DEVFS := $(shell grep 'CONFIG_DEVFS_FS=y' ../../linux/.config >/dev/null 2>&1 && echo "yes" || echo "no")
instead.
